Welcome to My Therapy Groups. These Terms of Service (“Terms”) are a binding agreement between you and My Therapy Groups LLC, a Colorado limited liability company doing business as My Therapy Groups (“My Therapy Groups,” “we,” “us,” or “our”), which owns and operates the website at mytherapygroups.com (the “Site”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Site.

1. About Our Service

My Therapy Groups is an online directory platform that connects individuals seeking group-based therapy, support, psychoeducation, and community services (“Group Seekers”) with the professionals and organizations that provide those services (“Providers”). We are a directory and communication platform only. We do not provide, endorse, recommend, or supervise any therapy, counseling, medical, or mental health services. Providers with active memberships may also have access to anonymized group requests submitted by Group Seekers in their service area, allowing them to identify community needs and offer relevant services.

2. Not a Healthcare Provider

My Therapy Groups is not a healthcare provider, licensed therapist, medical facility, or mental health service. We do not diagnose, treat, or provide any form of healthcare. The information on the Site, including listing descriptions, provider profiles, and reviews, is provided for informational purposes only and does not constitute medical advice, mental health advice, or a recommendation for any particular provider or service.

You should always consult with a qualified healthcare professional before making decisions about your mental health care. If you are in crisis or experiencing a mental health emergency, please call 911 or contact the 988 Suicide and Crisis Lifeline by calling or texting 988.

3. User Accounts

To access certain features of the Site, you must create an account. You agree to provide accurate, current, and complete information during registration and to update your information to keep it accurate. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must notify us immediately of any unauthorized use of your account.

4. Provider Responsibilities

Providers who list groups on the Site represent and warrant that:

• All information provided in their listings is accurate, current, and not misleading.
• They hold all necessary licenses, certifications, and credentials required by applicable law to provide the services described in their listings.
• They are solely responsible for the quality, safety, legality, and appropriateness of their services.
• They will comply with all applicable federal, state, and local laws and regulations.
• They will maintain appropriate professional liability insurance.

We do not verify provider credentials, licenses, or the accuracy of listing information. Listing on our platform does not constitute our endorsement or verification of any provider.

5. Group Seeker Responsibilities

Group Seekers acknowledge and agree that:

• They are responsible for independently verifying the credentials, qualifications, and suitability of any provider or group before participating.
• Participation in any group listed on the Site is entirely at their own risk.
• The Site is not a substitute for professional medical or mental health advice.
• They will use the Site’s communication features respectfully and lawfully.

By submitting a group request, you understand that the general nature of your request (such as type of group and location) may be shared with registered Providers to help match you with appropriate services. Your name and contact information will not be shared with Providers without your consent.

6. Payments and Subscriptions

Providers may subscribe to paid plans to access additional features. By purchasing a subscription, you agree to pay the applicable fees. Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. Payments are processed securely through our payment processor. We do not store your credit card information on our servers. Refunds are handled on a case-by-case basis at our discretion. You may cancel your subscription at any time through your account settings.

7. Content and Conduct

You are responsible for all content you post, upload, or transmit through the Site, including listing information, messages, reviews, and profile details. You agree not to post content that:

• Is false, misleading, defamatory, or fraudulent.
• Infringes on any third party’s intellectual property or privacy rights.
• Is harassing, threatening, discriminatory, or abusive.
• Contains viruses, malware, or other harmful code.
• Violates any applicable law or regulation.
• Promotes illegal activities.

All listings are subject to review and approval. My Therapy Groups reserves the right to reject, remove, or decline to publish any listing for any reason, including but not limited to content that does not align with the mission and values of our platform. We reserve the right to remove any content and suspend or terminate any account that violates these Terms, at our sole discretion and without prior notice.

8. Reviews

Users may submit reviews of groups and providers. Reviews must reflect genuine personal experiences and must not contain false statements, personal attacks, or confidential information about other group participants. We moderate reviews but do not verify their accuracy. Providers may respond to reviews. We reserve the right to remove reviews that violate these Terms.

9. Intellectual Property

All content on the Site that is not user-submitted, including the My Therapy Groups name, logo, design, text, graphics, and software, is the property of My Therapy Groups or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, modify, distribute, or create derivative works from any part of the Site without our prior written permission.

By submitting content to the Site (including listings, reviews, photos, and messages), you grant My Therapy Groups a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and distribute that content in connection with operating and promoting the Site. You represent that you have all necessary rights to grant this license.

10. Disclaimers

THE SITE AND ALL CONTENT, LISTINGS, AND SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, MY THERAPY GROUPS DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

WE DO NOT WARRANT THAT: the Site will be uninterrupted, secure, or error-free; the information on the Site is accurate, complete, or current; any provider listed on the Site is qualified, licensed, safe, or suitable for your needs; participation in any listed group will produce any particular outcome; or any defects will be corrected.

WE MAKE NO REPRESENTATIONS OR WARRANTIES ABOUT ANY PROVIDER, GROUP, SERVICE, OR INFORMATION LISTED ON THE SITE. YOUR USE OF THE SITE AND YOUR INTERACTIONS WITH ANY PROVIDER OR GROUP ARE ENTIRELY AT YOUR OWN RISK.

11. Limitation of Liability and Indemnification

To the maximum extent permitted by applicable law, in no event shall My Therapy Groups, its founder, employees, contractors, agents, suppliers, affiliates, or licensors be liable to you for any indirect, incidental, consequential, special, punitive, or exemplary damages, including without limitation damages for lost profits, lost revenue, lost data, loss of goodwill, business interruption, personal injury, emotional distress, or any other intangible losses, arising out of or relating to these terms, your use of or inability to use the site, your interaction with any provider, clinician, group leader, or organization listed in the directory, or any content you submit, post, or transmit through the site.

To the maximum extent permitted by applicable law, our total cumulative liability to you for any and all claims arising out of or relating to these terms, the site, or your use of any My Therapy Groups service shall not exceed the greater of (A) the total fees you paid to My Therapy Groups in the twelve months preceding the claim, or (B) one hundred United States dollars ($100 USD).

You acknowledge and agree that My Therapy Groups is a directory service and is not responsible for the quality, safety, legality, accuracy, credentials, conduct, or outcomes of any therapy, counseling, peer support, or group services provided by any third-party clinician, group leader, or organization listed on the site. Any interaction, agreement, communication, or transaction between you and a listed provider is solely between you and that provider, and My Therapy Groups is not a party to and assumes no liability for any such interaction.

The limitations and exclusions in this section apply regardless of the legal theory under which a claim is brought, including contract, tort, negligence, strict liability, statutory liability, or any other basis, and apply even if My Therapy Groups has been advised of the possibility of such damages and even if any limited remedy fails of its essential purpose.

You agree to defend, indemnify, and hold harmless My Therapy Groups, its founder, employees, contractors, agents, suppliers, affiliates, and licensors from and against any and all claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to (a) your use of the site, (b) your violation of these terms, (c) your violation of any third-party right, including any intellectual property, privacy, or publicity right, (d) any content you submit, post, or transmit through the site, (e) any dispute between you and any provider, clinician, group leader, or organization listed in the directory, or (f) any harm allegedly caused by services obtained through a directory listing. My Therapy Groups reserves the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with our defense of that claim.

Any claim or cause of action arising out of or relating to these terms or your use of the site must be filed within one (1) year after the claim or cause of action arose, or be forever barred, to the maximum extent permitted by applicable law.

Some jurisdictions do not allow the exclusion or limitation of certain damages, the disclaimer of certain warranties, or limitations on the time within which a claim may be brought, so some of the provisions above may not apply to you. Nothing in this section limits any non-waivable rights you have under the consumer protection laws of your country of residence. In those jurisdictions, our liability and your obligations are limited or modified to the maximum extent permitted by applicable law.

12. Governing Law and Jurisdiction

This agreement is governed by the laws of the State of Colorado, United States, without regard to its conflict of laws principles. You agree that any dispute, claim, or controversy arising out of or relating to this agreement, or your use of My Therapy Groups, will be resolved exclusively in the state or federal courts located in Denver, Colorado. By using My Therapy Groups, you consent to the personal jurisdiction of those courts.

If you access My Therapy Groups from outside the United States, you do so on your own initiative and are responsible for compliance with local laws. You agree that Colorado law and Denver, Colorado venue apply to you as a condition of using our services, regardless of where you are located.

Nothing in this section limits any non-waivable rights you have under the consumer protection laws of your country of residence.
